Terms of Service

Welcome to Busy Blooming. These Terms of Service ("Terms") govern your access to and use of the Busy Blooming website at https://busyblooming.ca, the Busy Blooming HQ members area at https://hq.busyblooming.ca, the Busy Blooming mobile applications (including our iOS app), any other Busy Blooming domain or application we operate, and any content, products, or services we make available (together, the "Services"). Please also review our Privacy Policy, which is incorporated into these Terms by reference.
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
1. Who We Are
Busy Blooming is an Ontario, Canada–based media brand operated as a sole proprietorship by Tessa Barclay ("Busy Blooming," "we," "us," "our"). You can reach us at hello@busyblooming.ca.
2. The Services
Busy Blooming offers:
• The public website at busyblooming.ca — free-to-browse information about Busy Blooming and the HQ membership.
• Busy Blooming HQ ("HQ") — a paid membership that provides access to curated content for social media creators, including weekly video meetings, audio voice notes, written briefings, content-idea reports, an idea vault, resource libraries, platform-update alerts, news summaries, live sessions, and related member tools. HQ is delivered through our website, the HQ members area, email, and the Busy Blooming app for iOS (with other platforms as we add them).
• Related digital products, events, and communications we may offer from time to time.
Publication cadence (for example, weekly meetings and monthly live sessions) is a target, not a guarantee: sessions may be rescheduled, replaced, or skipped for operational reasons.
We may add, modify, pause, or discontinue any part of the Services at any time. When a change materially affects paid members, we will provide reasonable advance notice by email or in-product notification.
HQ is a content membership. It is not coaching, consulting, audits, one-on-one feedback, guaranteed results, or professional advice of any kind. Content is provided for general informational purposes only.
3. Eligibility and Accounts
You must be at least 16 years old to create an account and at least the age of majority in your jurisdiction to purchase a paid membership. By creating an account, you confirm you meet these requirements.
Signing in to HQ uses passwordless magic links sent to your email address; we do not use account passwords. You agree to provide accurate, current, and complete information, to keep your account information up to date, and to keep your email account and sign-in links secure. You are responsible for all activity that occurs under your account. Notify us immediately at hello@busyblooming.ca if you believe your account has been used without your permission.
Accounts are personal and non-transferable. Each HQ membership is for a single individual. Sharing your account, sign-in link, magic-link email, or signed-in device with another person, or allowing another person to access paid content through your account, is not permitted and is grounds for suspension or termination without refund. We may investigate suspected account sharing or abuse (including by reviewing sign-in and usage records), revoke active sign-in links, and limit concurrent sessions or devices.
4. HQ Membership, Billing, and Cancellation
4.1 Pricing and Auto-Renewal
HQ is offered on a recurring subscription basis, billed monthly or annually. The price, currency, and billing interval are shown at checkout and may vary based on promotion or region. Your subscription will automatically renew at the end of each billing period at the then-current price until you cancel. By starting a subscription, you authorize us (through our payment processor, Stripe) to charge your payment method on file on each renewal date.
We may change subscription prices with reasonable advance notice. If you do not accept a price change, you may cancel before the change takes effect.
4.2 Payment Processing
Payments are processed by Stripe, Inc. Your payment information is submitted directly to Stripe and is governed by Stripe's terms and privacy policy. We do not store your full card details.
4.3 Cancellation
You may cancel your subscription at any time from your HQ account settings, or by emailing hello@busyblooming.ca. If you cancel without deleting your account, cancellation takes effect at the end of your current billing period and you retain access to HQ until that date. We do not provide partial refunds for cancellations mid-period.
Deleting your account is different from cancelling: if you delete your account (see Section 14), your access is revoked immediately, your subscription is set to cancel, and deletion does not entitle you to a refund for the remainder of the billing period.
4.4 Refunds
Except where required by applicable consumer-protection law, all charges are final and non-refundable, including charges for partially used billing periods, content you did not consume, and auto-renewal charges that occurred before cancellation.
If you believe you have been charged in error, contact hello@busyblooming.ca within 30 days of the charge and we will review the request in good faith.
4.5 Failed Payments and Suspension
If a renewal payment fails, we may retry the charge, suspend access to HQ, or cancel the subscription. You remain responsible for amounts validly owed.
4.6 Taxes
Prices do not include applicable sales or value-added taxes, which may be added at checkout based on your billing location.
4.7 The Mobile App
The Busy Blooming app is for accessing HQ with an existing account. Membership purchases, billing, cancellation, refunds, and support are handled by Busy Blooming and its payment providers, not by Apple Inc. ("Apple") or any other app-store operator. Apple has no obligation to provide maintenance or support for the app. As between Busy Blooming and Apple, Busy Blooming is responsible for the app and for addressing any claims relating to it (including product-liability, consumer-protection, intellectual-property, and legal or regulatory claims), except to the extent required by applicable law or Apple's applicable terms. Your use of the app must also comply with the app-store terms that apply to you, and Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to your use of the iOS app.
5. Intellectual Property
5.1 Our Content
All materials made available through the Services — including text, audio, video, images, graphics, logos, code, designs, layouts, templates, reports, summaries, and the "Busy Blooming" and "Busy Blooming HQ" names and marks — are owned by Busy Blooming or our licensors and are protected by copyright, trademark, and other laws. We reserve all rights not expressly granted to you.
5.2 Your Licence to Use HQ Content
Subject to these Terms and your payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use HQ content for your own individual, non-commercial reference.
5.3 What You May Not Do With Our Content
You may not, and may not permit others to:
• Copy, download, record, screen-capture, scrape, or archive any paid HQ content for redistribution.
• Share, republish, post, stream, sell, sublicence, or otherwise make HQ content available to any person who is not a current paid HQ member.
• Use HQ content, in whole or in part, to train, fine-tune, or evaluate any artificial intelligence or machine-learning system.
• Remove or obscure any copyright, trademark, or other proprietary notice.
• Use our name, logo, or brand in a way that suggests endorsement or partnership without our prior written consent.
Personal note-taking and quoting short excerpts with attribution for legitimate commentary, criticism, or journalism is permitted.
5.4 Feedback
If you send us ideas, suggestions, or feedback about the Services, you grant us a perpetual, irrevocable, royalty-free licence to use them without restriction or compensation.
5.5 Member Submissions and Private Tool Content
If you intentionally send us questions, examples, or other material — for support (including tech-support questions), feedback, Q&A, or possible inclusion in HQ content — you keep ownership of what you send, and you grant us a worldwide, royalty-free licence to host, copy, process, edit, excerpt, anonymize, publish, and display that submission as reasonably needed to operate and provide the Services. In particular, questions submitted for support may be edited, anonymized, and answered in Q&A posts or other HQ materials visible to other members.
Content you create or save privately inside HQ tools — including drafts, agenda items, saved preferences, and anything you enter into AI tools — remains private to your account. We host and process it only to provide those tools to you, and we will not publish it unless you separately choose to send it to us for support or publication.
Do not submit passwords, private client or brand information, confidential business information, or personal information about someone else unless you have permission to share it. You are responsible for the content you submit, and you confirm you have the rights needed to submit it and to allow us to use it as described.
6. Acceptable Use
You agree not to:
• Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to any part of the Services, any account, or any system or network connected to the Services.
• Interfere with, disrupt, overload, or probe the Services (including by scraping, using bots, or running automated tools against the Site).
• Reverse-engineer, decompile, or attempt to extract source code from any part of the Services, except as expressly permitted by law.
• Upload, post, or transmit any content that is unlawful, defamatory, harassing, obscene, infringing on intellectual-property rights, or that contains malware.
• Impersonate any person or misrepresent your affiliation.
• Use the Services to send unsolicited marketing, spam, or bulk communications.
• Engage in abusive, harassing, threatening, unlawful, or doxxing conduct directed at Busy Blooming, its operator, or other members in spaces we operate, moderate, or officially link to (including our Instagram group chat).
We may investigate and respond to suspected violations, including by suspending or terminating access without refund.
7. Third-Party Content, Links, and Embeds
HQ aggregates and links to third-party content, including:
• News summaries and platform-update alerts that link to original sources.
• Embedded content from platforms such as TikTok, Instagram, YouTube, Canva, and similar services.
• Tools, templates, and resources hosted or produced by third parties.
We do not own, endorse, control, or guarantee the accuracy, completeness, safety, or availability of third-party content, and we are not responsible for your interactions with third parties. Your use of any third-party service is subject to that third party's terms and privacy policy.
Third-party embeds and streams (for example, TikTok, Instagram, and YouTube posts, Canva reports, and live-session video and polls) may be removed, restricted, geo-blocked, or made unavailable by their platforms, or may require third-party cookies or accounts, at any time and without notice. We are not responsible if embedded or linked third-party material becomes unavailable.
If you choose to join an off-platform space we run or share, such as our Instagram group chat, your use of that platform is governed by that platform's terms and privacy policy. We do not control the platform, its moderation tools, message delivery, or other users' conduct.
8. AI-Assisted Content and AI Tools
Some HQ content, including news alerts and platform-update summaries, is generated or assisted by large language models with human editorial oversight. We label such content where reasonably practical. AI-assisted content may contain errors or omissions and is provided for general informational purposes only. Always consult the underlying sources before relying on any fact for a decision.
HQ also includes optional AI tools, such as the pitch drafter and idea sketches. You are responsible for the text you submit to these tools: do not submit confidential information, or personal information about someone else, unless you have the right to do so. AI outputs are drafts only. You are responsible for reviewing, editing, and verifying any AI-generated text before using or sending it, and we do not guarantee that outputs will be accurate, original, non-infringing, suitable for any brand relationship, or effective for any business purpose.
9. Notifications and Communications
When you use HQ you may receive:
• Transactional emails (account, billing, security) — these are required to use the Services and cannot be unsubscribed from while your account is active.
• Membership communications (new content, weekly updates) — you may unsubscribe at any time through the link in any email or in your account settings.
• Push notifications (if you opt in on a device) — you may turn these off in the app's settings or in your device or browser settings.
By providing your contact information you consent to receive related communications. You may withdraw consent at any time as described above, subject to our continued right to send transactional messages about your account.
10. Copyright and Takedown
If you believe content on the Services infringes your copyright, contact hello@busyblooming.ca with:
• A description of the copyrighted work;
• The URL or location of the allegedly infringing material;
• Your contact information;
• A statement that you have a good-faith belief that the use is not authorized; and
• A statement, under penalty of perjury, that the information is accurate and that you are the rights-holder or authorized to act on the rights-holder's behalf.
We will review each notice in good faith and remove or disable access to infringing material where appropriate.
11. Disclaimer of Warranties
THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any content will be accurate, current, or complete. We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law.
No content provided through the Services constitutes business, financial, legal, tax, medical, or other professional advice. You are solely responsible for your own decisions.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BUSY BLOOMING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR FOLLOWER GROWTH, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) CAD $100.
Some jurisdictions do not allow certain limitations; to that extent, the above limitations may not fully apply to you.
13. Indemnification
You agree to indemnify and hold Busy Blooming, its affiliates, and their respective officers, directors, employees, and agents harmless from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) content you submit or share through the Services.
14. Termination and Account Deletion
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. On termination:
• Your right to use the Services ends immediately.
• Any provisions that by their nature should survive (including Sections 5, 6, 11, 12, 13, 14, 16, and 17) will survive.
You may cancel your subscription as described in Section 4.3. You may also delete your account at any time using the Delete Account option in the Busy Blooming app, or by emailing hello@busyblooming.ca. Account deletion revokes access immediately and starts a 7-day recovery period, during which you can restore your account in the app. After that period, your member account and app data are permanently deleted and cannot be restored. If you delete your account, your subscription is set to cancel. Limited billing, tax, security, and legal records may be retained where required or permitted by law, as described in our Privacy Policy.
15. Changes to the Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and, for paid members, notify you by email or in-product notification. Continued use of the Services after the effective date of an updated version means you accept the changes. If you do not accept them, you must stop using the Services and may cancel your subscription.
16. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or related to the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Toronto, Ontario, except where applicable consumer-protection law gives you a non-waivable right to bring a claim elsewhere.
Before filing a formal claim, the parties agree to attempt in good faith to resolve the dispute by contacting hello@busyblooming.ca and discussing the issue for at least 30 days.
17. General
• Entire agreement. These Terms (together with our Privacy Policy and any order-specific terms) are the entire agreement between you and Busy Blooming regarding the Services.
• Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
• No waiver. Our failure to enforce any right is not a waiver of that right.
• Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Language. These Terms are drafted in English. Where a translated version is provided for convenience, the English version governs in the event of conflict.
